Drunk Driving in New York
When you are injured in an accident, you may be entitled to collect compensation from the at-fault party. To successfully recover damages, you are tasked with the burden of proving someone else was negligent. This means you will have to show that the other party had and violated the duty of care they owed you, and you were injured as a result.
The legal doctrine of negligence per se may afford you an easy opportunity to make your case. Negligence per se means there is a rebuttable presumption of negligence or an assumption of fact by the court. In other words, you will have an easier time proving your case and establishing negligence if the at-fault driver was charged with driving under the influence.
New York law prohibits drivers who are under the influence from operating a motor vehicle. The driving force behind these laws is to eliminate drunk driving accidents. If you are injured by a driver in violation of this law, you can use this to your benefit in a personal injury case.
In order to prove negligence per se, you must show:
- The other party violated a law
- By doing so, they caused the kind of harm the law was intended to prevent
- You were someone the law was designed to protect.
Specifically, you were injured because someone drove while under the influence, directly violating New York’s penal code.
After losing a loved one in a careless, reckless, or otherwise negligent New York car accident by no fault of the victim, it may feel like no amount of compensation could make you feel complete again. While it is true that no financial restitution can ever fully make up for your losses, filing a wrongful death claim against the responsible party or parties can go a long way toward helping you find some semblance of peace again.
