Pedestrian Deaths in New York
New York law entitles pedestrians to walk across driveways, down sidewalks, through parking lots, and many other areas without being hit and injured by a negligent driver. When pedestrian accidents happen, the right to sue for damages should be upheld.
It is not uncommon for a pedestrian to be seriously injured when they are struck by a car. Many pedestrian injuries are actually so severe, their quality of life is permanently affected.
Common pedestrian injuries include:
- Permanent disfigurement/Permanent scarring
- Broken bones/Fractured joints
- Spinal cord trauma
- Concussions/Traumatic brain injuries
A pedestrian can also be fatally injured during an accident. When this happens, surviving family members should weigh the benefits of filing a wrongful death claim against the at-fault driver. A wrongful death claim is similar to a personal injury claim but seeks additional compensation related to the victim’s passing.
After losing a loved one in a careless, reckless, or otherwise negligent New York pedestrian accident by no fault of the victim, it may feel like no amount of compensation could make you feel complete again. While it is true that no financial restitution can ever fully make up for your losses, filing a wrongful death claim against the responsible party or parties can go a long way toward helping you find some semblance of peace again.
