New York state abides by no-fault insurance regulations, this means that in most cases, pedestrians, drivers, and passengers are usually eligible to collect no-fault benefits. When seeking medical care for crash-related injuries sustained as a passenger during a New York car accident, you are not expected to prove negligence or liability on the part of the driver to receive these benefits. Financial compensation solicited under the umbrella of no-fault insurance typically includes medical costs, lost wages, and property damage.

New York’s no-fault insurance laws do stipulate that, as a passenger, you can only bring a claim against an insured driver for financial compensation if you endured severe injuries in the accident. The law defines severe injuries to include things like the loss of a limb, the loss of an unborn child, and injuries that result in the passenger’s wrongful death. The only impediment to bringing a claim of wrongful death under these circumstances would be if you are on the same insurance policy as the driver due to the fact that you cannot file a liability claim against your own insurance policy.
