The incident occurred at about 5:05 p.m. on State Route 14 in Horseheads.

An investigation revealed that 44-year-old Jon Gearhart was driving along State Route 14 when he pulled his vehicle onto the shoulder and was trying to remove a deer carcass from the travel lane when he was hit by a car. The driver of the striking vehicle then fled the scene.

Pedestrian Fatalities in New York

Recovering your damages following the preventable death of a family member is not always a straightforward process. In order for your wrongful death action to be settled in your favor, you will have to prove that the four elements of negligence were present, including:

  • The defendant owed your family member a duty of care
  • The defendant breached that duty by way of unsafe or unlawful actions
  • Your family member sustained damages (in this case, death)
  • The defendant’s breach was the direct cause of those damages

The most reliable way to prove these four elements were present is to gather as much pertinent evidence as you possibly can; a chore that is both hard and surprisingly tedious.

After decades of practicing personal injury law in New York, our wrongful death attorneys know the most effective methods of tracking down evidence that supports your version of the story and ensures that you are awarded the maximum amount of compensation.

After losing a loved one in a careless, reckless, or otherwise negligent New York pedestrian accident by no fault of the victim, it may feel like no amount of compensation could make you feel complete again. While it is true that no financial restitution can ever fully make up for your losses, filing a wrongful death claim against the responsible party or parties can go a long way toward helping you find some semblance of peace again.
