Malverne, NY (November 13, 2022) – A man from Baldwin is facing charges of felony manslaughter, among others, after his sedan collided with an SUV, forcing both vehicles off the highway and killing his passenger, on Saturday, November 12th in Malverne.

The crash took place at about 9:00 p.m. in the westbound lanes of Southern State Parkway between Exit 16 and Exit 17.

According to police, a BMW M3 driven by 40-year-old Haynes Harris rear-ended a Chevrolet Equinox. The impact pushed both vehicles into the righthand shoulder, causing the BMW to roll. The vehicle came to an uncontrolled stop after it crashed into a utility box. Harris’s passenger, 51-year-old Adrian Hall, a resident of New York City, was taken by ambulance to New York University Langone Hospital where he passed away.

Harris, who was also taken to NYU Langone in non-critical condition, is being charged with second-degree felony assault, second-degree felony manslaughter, second-degree felony reckless endangerment as well as driving while intoxicated and reckless driving, which are both misdemeanors.

The driver of the SUV was treated at the same hospital for injuries believed to be non-critical.

Driving Under the Influence in New York

Malverne, NY - Driver Charged in Crash That Killed Adrian Hall, Injured One on Southern State Pky

Under New York law, people who are intoxicated are prohibited from driving. The idea behind laws such as these is to prevent accidents caused by drunk or drugged drivers. If you have been injured or lost a family member due to a driver who chose to violate this law, you most likely have a valid New York wrongful death claim.

If the driver has been formally charged with a DUI, this is what is known as negligence per se and it can be used to prove negligence in a personal injury case because it proves that:

  • The defendant broke a law
  • In doing so, they induced the same type of harm the law was designed to deter
  • You or your family member were individuals whom this law was created to protect

In essence, one person was injured or killed because another person violated the state’s penal code by operating a vehicle while intoxicated. ,

After losing a loved one in a careless, reckless, or otherwise negligent New York car accident by no fault of the victim, it may feel like no amount of compensation could make you feel complete again. While it is true that no financial restitution can ever fully make up for your losses, filing a wrongful death claim against the responsible party or parties can go a long way toward helping you find some semblance of peace again.
