Subway Accidents in New York
Bringing a claim against a public transit authority is notoriously complex. After the accident, it is important to take immediate action in order to preserve evidence before it disappears and file a claim for damages. Claimants are faced with not only a short statute of limitations, but they must also take on the far-reaching resources of the Metro Transit Authority. Victims or their surviving family members will need an experienced New York personal injury lawyer to help them construct a solid case.
Claims against New York City, New York State, the New York City Transit Authority, NYC, and the Metro Transit Authority involve sovereign immunity. Filing a case against any of these government entities means adhering to strict guidelines. Your Notice of Claim must be filed within 90 days of the accident. This informs the agency of the injury and provides your contact information, the circumstances of the incident, as well as when and where it took place.
The agency then has 30 days to request a hearing. Claimants will have to testify under oath before they will be able to file their lawsuit. Personal injury suits must be filed within one year and 90 days from the cause of action, or within two years in the event of wrongful death.
Along with these specific and distinctive filing requirements, claimants also face the burden of proof; in this case, establishing negligence. Proving the MTA acted negligently can be exceptionally difficult, often requiring both substantial documented evidence and expert testimony. Considering the challenging nature of these cases, it is crucial to speak with a reputable New York subway accident lawyer as soon as possible after the accident.
After losing a loved one in a careless, reckless, or otherwise negligent New York accident by no fault of the victim, it may feel like no amount of compensation could make you feel complete again. While it is true that no financial restitution can ever fully make up for your losses, filing a wrongful death claim against the responsible party or parties can go a long way toward helping you find some semblance of peace again.
