Oakfield, NY (April 11, 2021) – Troopers from the Batavia Police Department were dispatched to Lockport Road after receiving reports of an ATV accident on Saturday, April 10th in the town of Oakfield.

An investigation showed that, at about 10:10 p.m., a 2014 Can-Am Outlander was driving northbound on Bliss Road at the Lockport Road intersection. As the ATV exited the intersection it crashed into a rock embankment, causing it to overturn multiple times.

The ATV’s operator, 43-year-old Thomas S. Butler, a resident of Oakfield, was thrown from the vehicle. He was pronounced dead at the scene.

His 55-year-old passenger was also ejected from the ATV and sustained non-critical injuries. They were airlifted to Erie County Medical Center for emergency medical treatment.

The investigation into this accident is still active.

 ATV Accidents in Oakfield

4.11 Oakfield, NY - Thomas S. Butler Killed, Passenger Airlifted Following ATV Accident on Lockport Rd

ATVs have a large fatal accident rate in New York. From 2007 to 2010, 314 people have been killed during ATV accidents. ATVs are serious motor vehicles that are able to reach highway speeds and weigh up to a quarter ton. Nationwide, about 300 people die on ATVs each year. Most of these fatalities are caused by injuries to the head and spinal cord. The high rate of accidents is partially attributed to the fact that many younger people use these vehicles with no training or understanding of how to safely operate them. In addition to this, newer ATVs are faster and heavier than their older counterparts as manufacturers compete to push the boundaries of speed, power, and weight.

After losing a loved one in a careless, reckless, or otherwise negligent New York accident by no fault of the victim, it may feel like no amount of compensation could make you feel complete again. While it is true that no financial restitution can ever fully make up for your losses, filing a wrongful death claim against the responsible party or parties can go a long way toward helping you find some semblance of peace again.
