If you were injured by a negligent driver who died in the accident or shortly after, you should speak with a New York personal injury attorney who can guide you through the process of filing a claim against the estate after it has been through probate. Even though an estate, just like a person, can be sued, there are several legal formalities that you need to follow.

According to New York law, if you are injured by another person, you are entitled to file a personal injury claim, even if the at-fault party is deceased. The decedent’s estate will have a personal representative or an executor. One of their duties is to challenge your claim for medical expenses, lost income, pain and suffering, and other damages stemming from the accident.

The estate of the deceased driver must go through probate before you can act on your personal injury claim. Probate is the process that divides the estate into inheritances, and bequests. and pays off debts.

Your claim will make you a potential creditor, and if it settles or is won at trial, the estate will be required to pay you your award or settlement like any other debt.

A dependable car accident attorney is in the best position to give you reliable advice that will help you secure the compensation you deserve.
