Passenger Fatalities in the Southern Tier

Southern Tier, NY - Brian Hitchcock Killed in Crash on SR-70

New York state follows no-fault insurance laws, meaning that, in most instances, passengers, drivers, and pedestrians are typically qualified to receive no-fault benefits. When soliciting medical treatment for accident-related injuries you sustained as a passenger in a New York car accident, you are not required to show liability or negligence on the part of the driver in order to obtain these benefits. Financial compensation sought under the umbrella of no-fault insurance usually includes medical expenses, lost income, and damage to property.

New York’s no-fault insurance rules do state that, as a passenger, you may only bring a claim against an insured driver for financial compensation if you sustained serious injuries during the accident. The law does state that serious injuries include things such as the loss of a limb, the loss of an unborn child, and injuries that result in the passenger’s wrongful death. The only hindrance to bringing a claim of wrongful death under these circumstances would be if you are on the same insurance policy as the driver because you can’t file a liability claim against your own insurance policy.
