Line-of-Duty Injuries in Troy

3.14 Troy, NY - Firefighter Receives 2nd Degree Burns Fighting House Fire on 2nd St

Generally speaking, any worker who is qualified to collect worker’s compensation benefits for an injury they suffered while they were working is prevented from filing a suit against their employer for the same line-of-duty injuries. Firefighters in New York who sustain injuries in the line of duty, however, are not allowed to receive workers’ compensation.

Their medical expenses and lost wages are managed by the city in which they work. This means that, due to the fact that New York firefighters are not given the benefit worker’s compensation protections, they are eligible to file a personal injury claim against their employer for any injuries they endured in a line-of-duty accident in New York.
