Drunk Driving in New York
When you are hurt in a negligence-based accident, you are entitled to collect compensation from the at-fault driver. In order to recover damages, you will have to prove the other party’s negligence. This means you will have to demonstrate that they had and violated the duty of care they owed you, and you were injured as a result.
The legal doctrine of negligence per se may afford you an easier opportunity to present your case. Negligence per se is a rebuttable presumption of negligence; an assumption of fact by the court. In other words, you will have a simpler time proving negligence in your case if the at-fault driver was cited or charged with an infraction, such as driving under the influence.
New York law prohibits drivers who are under the influence from operating a motor vehicle. The driving force behind these laws is to eradicate drunk driving accidents. If you are injured by a driver in violation of this law, you can use this to your advantage in a personal injury case.
In order to prove negligence per se, you must show:
- The other party violated a law
- By doing so, they caused the kind of harm the law was intended to prevent
- You were someone the law was designed to protect.
Specifically, that you were injured because someone drove under the influence, directly violating New York’s penal code.
Being injured in a motor vehicle accident can be an extremely disruptive, frightening, confusing, and overwhelming time in a person’s life. After being hurt in a car crash that was not your fault, the last things you need to be concerned with are the financial obligations and other stressors that only make physical recovery more challenging. Making sure that you have compassionate and skilled representation to fight for your rights so you don’t have to battle insurance companies on your own will go a long way toward helping you move forward.
