Delaware Police Reports: State Police, Cities and Insurance Rules
Who has your crash report, what drivers must report, insurance rules and traffic deaths in Delaware.
With so much traffic moving along these major routes, crashes can happen anywhere from busy highways to local streets. Depending on where yours happened, the report could be handled by Delaware State Police, New Castle County Police, the Delaware River and Bay Authority Police on the Delaware Memorial Bridge, or a local city or town department.
The agency that responded to your crash is the place to start when you need a copy of the report.
Who Has Your Delaware Crash Report
The Delaware State Police investigated about two of every three reportable crashes in the state in 2024, according to DSP’s annual traffic report. City and town police take reports within their own limits, and New Castle County runs a county police department of its own. Crashes on the Delaware Memorial Bridge go to the Delaware River and Bay Authority Police.
State Police reports are requested by mail only, and DSP does not take walk-in requests. Send your request to Delaware State Police, Traffic Operations Section, P.O. Box 430, Dover, DE 19903, with a copy of your collision information exchange form and your payment.
A standard collision report costs $25, and a fatal collision report costs $60, by check or money order payable to the Delaware State Police. DSP takes questions at (302) 739-5931, weekdays from 8 a.m. to 4 p.m.
Delaware Memorial Bridge reports come from the Delaware River and Bay Authority Police, on its Traffic Collision Report Request form. A report costs $25, or $60 for a fatal crash, prepaid by certified check, money order, or business check payable to the Delaware River and Bay Authority; personal checks and credit cards are not accepted.
Mail the form and a copy of your photo ID to the DRBA Police Department, Attn: Records Unit, P.O. Box 71, New Castle, DE 19720, and choose email or mail delivery. Only the drivers and vehicle owners involved, and insurers for their insured, can request one, and reports are usually ready in 7 to 10 business days.

Police Reports From Delaware Cities and Towns
Each city and town department releases its own crash reports, so start with the department that responded. Four departments post their request routes:

These departments release reports to the people involved in the crash. Dover, Newark and New Castle County also release them to vehicle owners; Wilmington, Dover and Newark release them to insurers, and New Castle County releases only reports a supervisor has approved.
What Delaware Drivers Must Report
Under 21 Delaware Code section 4203(a), a driver must immediately report a crash to the police agency responsible for that location when anyone is hurt or killed, when a crash on a public highway causes apparent property damage of $2,000 or more, or when a driver’s ability was impaired by alcohol or drugs. Smaller crashes can be reported voluntarily.
For those crashes, the police agency investigates and completes the State of Delaware Uniform Traffic Collision Report. The Department of Safety and Homeland Security may require drivers or police to file a supplemental report on its forms when it finds the original report insufficient, and those supplemental reports are not open to public inspection. Failing to report carries a fine of $25 to $75 for a first offense, and $57.50 to $95 for another offense within 24 months under 21 Delaware Code section 4205.
Delaware Car Insurance Requirements and Fault Rules
Policies written or renewed since December 13, 2017 must carry at least $25,000 for injury or death to one person, $50,000 for two or more people and $10,000 for property damage under 21 Delaware Code section 2902. That law, House Bill 114, raised the old $15,000, $30,000 and $5,000 minimums.
Every Delaware policy must also carry personal injury protection of at least $15,000 per person and $30,000 per crash, plus up to $5,000 for funeral costs under section 2118. PIP pays medical bills and lost wages for you and your passengers, regardless of who caused the crash, and you can choose a deductible in writing.
Delaware is still a fault state, and there is no injury threshold to sue: you can claim against the driver who caused the crash for losses PIP does not cover, though damages your PIP coverage applies to, including any deductible you chose, cannot be claimed in that lawsuit under 21 Delaware Code sections 2118(f) and (h).
Uninsured motorist coverage comes with every policy at the state minimum limits unless you reject it in writing on your insurer’s form, and its property damage part carries a $250 deductible under 18 Delaware Code section 3902. Insurers must also offer higher limits, including underinsured motorist coverage, up to $100,000 per person and $300,000 per crash.
Shared fault does not end a claim. Under 10 Delaware Code section 8132, you can recover if your own negligence was no greater than the other side’s, and your award is reduced by your share of the blame.

Is Delaware a no-fault state?
No. Delaware is a fault state that requires every policy to carry personal injury protection. PIP pays your own medical bills and lost wages, up to $15,000 per person, regardless of who caused the crash. Delaware sets no injury threshold for lawsuits, so you can still claim against the at-fault driver for losses your PIP does not cover.
How long do I have to file a car accident claim in Delaware?
Two years from the injury for personal injury claims under 10 Delaware Code section 8119, and two years for wrongful death and vehicle damage under 10 Delaware Code section 8107. A town or county may require written notice of a claim by ordinance, and notice within one year is timely under 10 Delaware Code section 4013. Claims against the city of Wilmington need written notice to the Mayor within one year under 10 Delaware Code section 8124.
