What Happens After a DUI-Related Crash in Lincoln, Nebraska?
When a driver is found to have a blood alcohol content above the legal limit of .08 following a crash, they can face both criminal charges and civil consequences. A second DUI offense typically carries heavier penalties than a first, which may include longer license suspensions, higher fines, and possible jail time depending on the circumstances.
Nebraska uses a per se DUI law, meaning a BAC at or above .08 is enough on its own to support a charge, regardless of how the driver appeared to be performing. In crashes where others are hurt, the driver may also face additional charges tied to those injuries. The presence of a prior DUI on record tends to affect how prosecutors and courts handle the new case.
