Waukesha County, WI (June 30, 2026) – A Milwaukee man was arrested after a van left I-94 and entered a ditch near Moorland Road on Saturday, June 27. The roadway departure happened at about 9:11 p.m., and the people inside the vehicle were taken to the hospital with non-fatal injuries.
According to the Wisconsin State Patrol, open intoxicating beverages were found inside the van. Investigators said the driver, 40-year-old Victor Hugo Fragoso Figueroa of Milwaukee, showed signs of impairment and refused standardized field sobriety tests.
Fragoso Figueroa was arrested on suspicion of operating a motor vehicle under the influence, third offense, with two children under the age of 16 inside the van. A blood sample was obtained for testing before he was booked into the Waukesha County Jail.
The circumstances surrounding the accident are still being examined as the case moves forward. We wish everyone who was hurt a smooth and complete recovery.
What Happens During a DUI Investigation After a Roadway Departure?
When a vehicle leaves the roadway, investigators often review several factors to determine what may have contributed to the loss of control. They may examine tire marks, vehicle damage, roadway conditions, witness statements, and any available video footage. Medical records and the occupants’ positions can also help establish how the vehicle traveled before coming to rest.
If impairment is suspected, officers may document observations of the driver’s behavior and collect chemical evidence, such as a blood sample, subject to applicable laws. Results from laboratory testing, along with physical evidence and other findings, are considered together before prosecutors decide how to proceed. This process helps ensure that charging decisions are based on documented evidence rather than assumptions.
