What Happens If the At-Fault Driver Is Uninsured?
When the at-fault driver does not carry insurance, recovery for injuries and vehicle damage can become more complicated. In many states, uninsured motorist (UM) coverage allows an injured person to file a claim through their own auto policy for medical bills, lost wages, and certain other damages. Property damage may also be covered if uninsured motorist property damage (UMPD) coverage is included. If no such coverage exists, the injured person may need to pursue compensation directly from the uninsured driver, which can be difficult if that driver lacks financial resources. Policy limits, deductibles, and state laws all affect how much compensation may be available.
