What Is a Wrongful Death Claim After a Fatal Crash?
A wrongful death claim is a civil legal action filed when a person dies due to another party’s negligent or reckless behavior. After a fatal crash, this type of claim may arise if the collision was caused by actions such as speeding, distracted driving, impaired driving, or failure to follow traffic laws.
Unlike a criminal case, which focuses on punishment, a wrongful death claim seeks financial compensation for surviving family members. These claims are typically filed by close relatives, such as a spouse, child, or parent, depending on state law.
Compensation may cover medical bills related to the crash, funeral and burial costs, lost income the person would have earned, and loss of companionship or support. The exact damages available vary by state.
